AB 1064: Leading Ethical AI Development (LEAD) for Kids Act.
This bill, the Leading Ethical AI Development (Lead) for Kids Act, requires that certain artificial intelligence systems that have over 1,000,000 monthly visitors or users and are publicly accessible within the state's geographic boundaries provide an AI detection tool to users. This tool allows users to assess whether content was created or altered by the AI system. The bill prohibits the creation of companion chatbots that are foreseeably capable of harming children, including encouraging self-harm, suicidal ideation, violence, or disordered eating. It also requires that companion chatbots be designed and tested to prevent such harm. The bill authorizes the attorney general to recover a civil penalty for violations and allows children or their parents/guardians to bring civil actions to recover actual damages. The provisions of the bill are severable.
