AB 1222: Public utilities: judicial review.
This bill aims to amend the Public Utilities Code to enhance judicial review of the Public Utilities Commission's decisions. The 30-day time period for filing a petition for a writ of review would be extended to 90 days. A new presumption would be introduced, requiring the court to presume the commission's final decision is valid and lawful, unless the commission can justify it to the court's satisfaction. The bill would also prohibit electrical corporations from recovering costs associated with seeking judicial review from their ratepayers, and require the corporation to track these costs. This provision would prevent electrical corporations from passing on the costs of judicial review to consumers.
