AB 1279: Criminal procedure: sentencing.
This bill would amend the state's sentencing laws to remove prior juvenile adjudications or convictions for offenses committed before age 18 from being considered prior serious or violent felony convictions for purposes of sentence enhancement. It would provide a means of vacating these prior convictions and resentencing defendants on remaining counts. The bill would require the participation of district attorneys and public defenders in the resentencing process and impose a state-mandated local program. Reimbursement for costs mandated by the state would be made pursuant to existing statutory provisions if the commission on state mandates determines that the bill contains such costs.
