AB 1297: Automatic temporary restraining orders.

This bill amends the family code to extend the protections of temporary restraining orders to insurance coverage. Temporary restraining orders issued in proceedings related to marriage, dissolution, or legal separation would remain in effect until the case is resolved or further court order is given. Starting January 1, 2027, both parties subject to a temporary restraining order would be prohibited from allowing a plan to lapse due to nonpayment of premiums or failing to renew insurance coverage. This protection applies to various types of insurance, including life, health, automobile, and disability insurance, held for the benefit of the parties and their child or children.
