AB 1385: Unlawfully restrictive covenants: housing developments: Palisades Fire.
The bill aims to amend the civil code to protect affordable housing developments from restrictive covenants. A recorded restrictive covenant would be unenforceable against the owner of an affordable housing development if an approved affordable housing modification document has been recorded in the public record. This provision would apply to developments located on property subject to a recorded restrictive covenant in a county under a state of emergency declared due to a disaster or extreme peril. The bill also requires county officials to impose additional duties, which would result in a state-mandated local program.
