AB 2273: Crimes: SCRIVNER Act.

This bill amends certain sections of the penal code to enhance penalties for crimes involving minors. It removes the requirement of intent to arouse or gratify lust, passions, or sexual desires if the perpetrator was under the influence of a mind- or mood-altering substance. This expansion of the scope of a crime creates a state-mandated local program. The bill also requires the department of justice to bring charges against a person holding an elected office who committed specified crimes if the victim was a minor and the case is deemed appropriate for prosecution within 30 days. Additionally, the bill modifies pretrial diversion rules to make defendants ineligible if the facts alleged would constitute certain offenses, regardless of whether charges are formally filed. The bill does not require reimbursement for certain costs mandated by the state.
