AB 35: Safe Drinking Water, Wildfire Prevention, Drought Preparedness, and Clean Air Bond Act of 2024: Administrative Procedure Act: exemption: program guidelines and selection criteria.
This bill amends the public resources code to exempt the adoption of regulations needed to implement certain environmental programs from the requirements of the administrative procedure act. The regulations can be adopted without filing with the office of administrative law, and they can remain in effect until repealed or amended. The bill allows state entities to develop and use previously developed program guidelines and selection criteria for competitive grant programs. These guidelines must be submitted to the secretary of the natural resources agency and posted on their internet website. The regulations will take effect immediately, and the bill declares its urgency. This means that the bill can be passed and take effect right away, without waiting for a regular legislative session.
