AB 358: Criminal procedure: privacy.

This bill aims to protect individuals' privacy by expanding the Electronic Communications Privacy Act. It would allow government entities to access electronic device information with the consent of the device's authorized possessor, in cases where the device is believed to have been used to track or record the individual without their permission. The government entity must then apply for a warrant or order within three court days, and the court must promptly rule on the application and destroy the obtained information if the facts do not justify the emergency access. The bill also allows individuals to petition a court to void or modify a warrant, order, or process that is inconsistent with the law or the constitution, and to order the destruction of obtained information.
