AB 364: Personal information: maintenance.

This bill would enact the Stop Foreign Governments from Accessing Californians' Sensitive Personal Information Act, which would require businesses to disclose to consumers if they intend to maintain personal information outside of the United States. Businesses would be prohibited from maintaining personal information outside of the United States unless the consumer explicitly consents to this action. Additionally, businesses would be prohibited from maintaining certain types of personal information, such as healthcare information, financial information, and geolocation data, in the custody of foreign governments or third parties owned or controlled by foreign governments. The bill aims to further the purposes and intent of the California Privacy Rights Act of 2020.
