AB 446: Surveillance pricing.

This bill aims to protect consumers by prohibiting grocery establishments from engaging in "surveillance pricing", which involves offering customized price increases based on personally identifiable information collected through electronic surveillance technology. The bill would require grocery establishments to display clearly readable prices on 85% of packaged consumer commodities offered for sale. Only a public prosecutor can bring an action against violators to recover civil penalties, and consumers can also bring actions for injunctive relief and reasonable attorney's fees. The bill declares that any waiver of its provisions is against public policy and is void and unenforceable. It further supports the purposes and intent of the California Privacy Rights Act of 2020.
