SB 1217: Nonconsensual Intimate Image Clearinghouse.

The proposed law establishes a clearinghouse to help individuals who were exploited in California remove nonconsensual intimate images from online platforms. Nonconsensual intimate images are defined as authentic intimate images distributed without consent, digitally altered images, or images created when the depicted person was a minor. The clearinghouse would require covered platforms to remove verified matches within 48 hours and prevent images from being uploaded again. A peace officer investigating certain offenses must advise victims of the clearinghouse and provide certain information to the clearinghouse. Civil penalties would be imposed for violations, and a reimbursement process would be established to cover state-mandated costs. The law would take effect on January 1, 2029.
