SB 355: Judgment debtor employers: Employment Development Department.

This bill requires employers who have been ordered to pay a judgment to provide documentation to the labor commissioner within 60 days, stating that the judgment is paid or that an agreement has been made to pay in installments. The employer must also post a bond or comply with the agreement. If the employer fails to comply, they are liable for a civil penalty. The labor commissioner will then notify the employer that the judgment will be submitted to the Employment Development Department as a notice of potential tax fraud, and the employer must pay the penalty within 90 days.
