SB 676: California Environmental Quality Act: judicial streamlining: state of emergency: wildfire.
This bill requires a lead agency to prepare a record of proceedings concurrently with the administrative process for certain projects in areas declared a state of emergency due to wildfires. The project must be to maintain, repair, restore, demolish, or replace property or facilities damaged or destroyed by the wildfires. The lead agency must prepare the record of proceedings within 270 calendar days of the filing of the certified record of proceedings. Any action to review or set aside the certification of an environmental impact report must be resolved within 270 calendar days. The applicant must agree to pay the costs of the trial court and court of appeal. The project must be consistent with applicable zoning and land use ordinances.
