SB 820: Inmates: mental health.
This bill would allow for the administration of antipsychotic medication to individuals found incompetent to stand trial without prior informed consent in emergency situations. The medication would be administered in the least restrictive manner possible and would only be valid for up to 72 hours. A court would need to find by clear and convincing evidence that the individual has a serious mental health disorder that can be treated with antipsychotic medication and that there is no less intrusive alternative. The bill would also require the court to review the order at least every 60 days and for the psychiatrist to file an affidavit at that review. Certain rights for individuals would be enumerated prior to the administration of involuntary medication.
