Section 318 of the vehicle and traffic law is amended by 2 adding a new subdivision 16 to read as follows: 3 16. Notwithstanding any provisions of this section, the commercial 4 driver's license of a person who has had their registration or license 5 revoked or suspended pursuant to any provision of this section shall not 6 be revoked or suspended provided that such person has filed with the 7 commissioner a statement, in a form prescribed by the commissioner, 8 indicating that they need such commercial driver's license to perform 9 their employment and that such driver shall only be allowed to drive 10 their work vehicle while in the performance of their employment. Upon 11 receipt of the foregoing statement the commissioner shall restrict the 12 driver to a commercial driver's license until new proof of financial 13 security has been secured. 14 § 2.
