What A 10904 does, verified May 4, 2026

The "Small Business Health Plan Act" aims to provide small businesses with more flexibility in offering health insurance to their employees. This act allows insurers to offer individual and/or small group accident and health insurance policies to small business owners and employees that do not require the same coverages as other policies under the Insurance Law. The act exempts small businesses from certain insurance requirements, allowing them to subsidize health insurance policies for their employees. This exemption applies to policies that do not provide for coverages required under the Insurance Law, and may include riders for additional coverages. The act also prohibits certain provisions of the Insurance Law from applying to small businesses, including certain sections that relate to individual and group insurance policies.
