What A 11113 does, verified May 1, 2026

This act amends the Town Law and the Public Officers Law to specifically authorize the town attorney of the Town of Islip in Suffolk County to be a nonresident of that town. The legislation adds a new provision to the Town Law stating that the town attorney for Islip need not be an elector of the town, while maintaining the requirement for all other towns that their attorneys must be electors unless the legislature provides otherwise. Additionally, the act modifies the Public Officers Law to exempt the town attorney of Islip from the general residency requirement for public officers, provided the attorney resides within Suffolk County. For all other towns, the law continues to require that the person performing the function of town attorney be a resident of that town unless otherwise specified by law. The act takes effect immediately upon passage.
