  STATE OF NEW YORK ________________________________________________________________________ 1137 2025-2026 Regular Sessions  IN ASSEMBLY January 9, 2025 ___________ Introduced by M. of A. SANTABARBARA -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to excluding money raised by fundraising for volunteer emergency medical services when allocating state funding The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 3005-c to read as follows: 3 § 3005-c. Fundraising by volunteer ambulance companies. 1. For 4 purposes of this section a "fundraising activity" means a method of 5 raising funds to effectuate the lawful purposes of a volunteer ambulance 6 company, but shall not include any method prohibited by the state 7 constitution or the penal statutes of this state, or the conduct of a 8 business or other commercial enterprise except on temporary basis for a 9 period or periods not to exceed a total of ninety days in any calendar 10 year. 11 2. Monies generated from fundraising activities shall not be consid- 12 ered when determining state aid or reimbursement for services to partic- 13 ipating volunteer ambulance companies, including regional emergency 14 medical councils. 15 § 2.
