  STATE OF NEW YORK ________________________________________________________________________ 1140 2025-2026 Regular Sessions  IN ASSEMBLY January 9, 2025 ___________ Introduced by M. of A. SEAWRIGHT, STECK, JACKSON, McMAHON, BURDICK, WEPRIN -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to the definition of consent The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 10.00 of the penal law is amended by adding a new 2 subdivision 23 to read as follows: 3 23. "Consent" means a freely given, knowledgeable and informed agree- 4 ment by a person with the capacity to reason. 5 § 2. This act shall take effect on the ninetieth day after it shall 6 have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.
