What A 11689 does, verified September 27, 2026

This bill amends the Environmental Conservation Law of New York to formally classify all waste containing source, byproduct, or special nuclear material as "radioactive waste." Under the new provisions, such radioactive waste will be considered hazardous waste, provided that its regulation and cleanup are not preempted by federal law. The legislation also updates the definition of "hazardous waste" to explicitly include radioactive waste while maintaining existing exclusions for natural gas, vehicle engine residues, and specific nuclear materials subject to federal financial protection requirements. Additionally, the bill clarifies that petroleum products are excluded from the hazardous waste definition even if they appear on certain promulgated lists. The act is designed to take effect immediately upon passage.
