SEAWRIGHT, BORES, WEPRIN -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to increasing the penalties for leaving the scene of an accident involving an elec- tric scooter without reporting in the second degree and leaving the scene of an accident involving an electric scooter without reporting in the first degree and providing increased penalties for leaving the scene of an accident involving a wheeled non-motorized means of conveyance without reporting in the first and second degrees when the vehicle involved is a bicycle with an electric assist system The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 1287 of the vehicle and traffic 2 law, as added by section 10 of part XX of chapter 58 of the laws of 3 2020, is amended to read as follows: 4 2. Leaving the scene of an incident involving an electric scooter 5 without reporting in the second degree is a [violation] class A misde- 6 meanor. 7 § 2. Subdivision 2 of section 1288 of the vehicle and traffic law, as 8 added by section 10 of part XX of chapter 58 of the laws of 2020, is 9 amended to read as follows: 10 2. Leaving the scene of an incident involving an electric scooter 11 without reporting in the first degree is a class [B misdemeanor] E felo- 12 ny. 13 § 3. Section 1240 of the vehicle and traffic law is amended by adding 14 a new subdivision 3 to read as follows: 15 3. Notwithstanding subdivision two of this section, leaving the scene 16 of an incident involving a bicycle with electric assist without report- 17 ing in the second degree is a class A misdemeanor. 18 § 4. Section 1241 of the vehicle and traffic law is amended by adding 19 a new subdivision 3 to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.  A. 1251 2 1 3. Notwithstanding subdivision two of this section, leaving the scene 2 of an incident involving a bicycle with electric assist without report- 3 ing in the first degree is a class E felony. 4 § 5. This act shall take effect on the sixtieth day after it shall 5 have become a law. Effective immediately, the addition, amendment 6 and/or repeal of any rule or regulation necessary for the implementation 7 of this act on its effective date are authorized to be made and 8 completed on or before such effective date.
