A 1395: Permits a close friend to make an anatomical gift of a decedent's body.

New York · Assembly · 2025–2026 Legislative Session · last verified November 22, 2025

What A 1395 does, verified November 22, 2025

The bill aims to permit a close friend of a deceased person to make an anatomical gift of the body. This is allowed for a close friend as defined in a specific section of the public health law, who is considered authorized to dispose of the body. If there are multiple members of the same class who are reasonably available, an anatomical gift can be made by a member of that class unless they know of an objection. In such cases, the gift can be made only by a majority of the members of the class who are reasonably available. The amendment also requires that any changes to the law be agreed upon by a majority of the reasonably available members.
