A 1477: Allows withdrawals from family tuition accounts to pay for treatment of substance use disorder, including detoxification and rehabilitation for the designated beneficiary.
The bill aims to amend the education law to provide more flexibility for families withdrawing funds from a Family Tuition Account (FTA) to cover treatment for substance use disorder. An account owner can withdraw all or part of the account balance with 60 days' notice or a shorter period as authorized by the program's rules. The rules must include provisions to determine whether the withdrawal is a nonqualified or qualified withdrawal. A qualified withdrawal includes using the funds for treatment of substance use disorder, including detoxification and rehabilitation, for at least 15 hours and may include classroom instruction. The bill takes effect immediately.
