What A 169 does, verified March 31, 2026

The bill aims to strengthen laws related to cemetery desecration in New York. It defines two degrees of cemetery desecration: first degree and second degree. First degree cemetery desecration involves committing second degree cemetery desecration and having a prior conviction within the past five years, while second degree cemetery desecration involves damaging property at a cemetery plot or grave without permission, or stealing property exceeding $250 value from a cemetery. The bill increases the penalty for second degree cemetery desecration to a class E felony and introduces a new class D felony for first degree cemetery desecration. The current section 145.22 of the penal law is repealed. The bill takes effect on November 1st of the next year after it becomes a law.
