A 1847: Provides a performance and discharge of duty presumption for any condition of impairment of health caused by leptospirosis, resulting in total or partial disability or death to a paid member of the uniformed force of a paid sanitation department, where such paid member is drawn from competitive civil service lists, who successfully passed a physical examination on entry into the service of such department, which examination failed to reveal any evidence of such condition.
The proposed legislation provides a rebuttable statutory presumption that a qualifying partial or total disability or death related to leptospirosis was incurred in the performance of duty for members of the uniformed force of sanitation departments in certain cities. This presumption would apply to paid members of these departments who are drawn from competitive civil service lists and have successfully passed a physical examination. The presumption would not be affected by the contrary evidence, unless proven otherwise. The legislation would take effect immediately. The general municipal law is amended by adding a new 2 section 207-aa to read as follows: 3 § 207-aa. Disabilities of members of the uniformed force of sanitation 4 departments caused by leptospirosis. 1. Notwithstanding the provisions 5 of any general, special, or local law to the contrary, any condition of 6 impairment of health caused by leptospirosis that results in total or 7 partial disability or death to a paid member of the uniformed force of a 8 sanitation department, where such member is drawn from competitive civil 9 service lists and successfully passed a physical examination upon entry 10 into the service of such sanitation department, and such examination 11 failed to reveal any evidence of such condition, shall be presumptive 12 evidence that such condition was incurred in the performance and 13 discharge of such member's duty, unless competent evidence proves other- 14 wise. 15 2. The provisions of this section shall not apply to the workers' 16 compensation law and the labor law. 17 § 2. This act shall take effect immediately.
