  STATE OF NEW YORK ________________________________________________________________________ 2154 2025-2026 Regular Sessions  IN ASSEMBLY January 15, 2025 ___________ Introduced by M. of A. JONES -- read once and referred to the Committee on Ways and Means AN ACT to amend the state finance law, in relation to establishing a water and waste water treatment system capital fund; and making an appropriation therefor The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The state finance law is amended by adding a new section 2 97-bbbbb to read as follows: 3 § 97-bbbbb. Water and waste water treatment system capital fund. 1. 4 There is hereby established in the joint custody of the state comp- 5 troller and the commissioner of taxation and finance a special capital 6 fund to be known as the "water and waste water treatment system capital 7 fund", hereinafter referred to as "the fund". 8 2. The fund shall consist of all moneys collected therefor or credit- 9 ed or transferred thereto from any other fund, account or source. Any 10 interest received by the comptroller on moneys on deposit in the transit 11 assistance for capital investments fund shall be retained in and become 12 a part of such fund. 13 3. Moneys in the fund shall, following appropriation by the legisla- 14 ture, be utilized for capital purposes, including, but not limited to 15 the planning and design, acquisition, construction, reconstruction, 16 replacement, improvement, reconditioning, rehabilitation and preserva- 17 tion of water and waste water treatment systems. 18 4. Moneys deposited into the fund shall be available to municipalities 19 throughout the state through a grant program established by the comp- 20 troller, in consultation with the commissioner of taxation and finance. 21 5. All payments of moneys from the transit assistance for capital 22 investments fund shall be made on the audit and warrant of the comp- 23 troller.  A. 2154 2 1 § 2. Appropriation. The sum of two hundred million dollars 2 ($200,000,000), or so much thereof as may be necessary, is hereby appro- 3 priated to the water and waste water treatment system capital fund out 4 of any moneys in the state treasury in the general fund, not otherwise 5 appropriated, and made immediately available, for the purpose of carry- 6 ing out the provisions of this act. Such moneys shall be payable on the 7 audit and warrant of the comptroller on vouchers certified or approved 8 by the state fire administrator in the manner prescribed by law. 9 § 3. This act shall take effect immediately.
