A 2560: Suspends the registration of a vehicle which has been documented multiple times within a period by a photo violation monitoring device for failure to comply with traffic-control indications.
The proposed law aims to address the issue of drivers failing to comply with traffic control signals. A vehicle that has been documented six times within a 12-month period for failure to comply with traffic-control indications will have its registration suspended for 15 days. A vehicle documented nine times within a 24-month period will have its registration suspended for 30 days. A vehicle documented 12 times within a 36-month period will have its registration suspended for 90 days. This law does not apply to rental vehicles. The Department of Motor Vehicles will alert the vehicle owner via certified mail after the fourth, seventh, and tenth documentation by a photo violation monitoring device that their vehicle will be suspended after two more violations. The law will take effect immediately.

The vehicle and traffic law is amended by adding a new 2 section 1118 to read as follows: 3 § 1118. Failure to comply with traffic control signal. (a) The regis- 4 tration of a vehicle which has been documented six times within a twelve 5 month period by a photo violation monitoring device for failure of an 6 operator thereof to comply with traffic-control indications shall be 7 suspended for a period of fifteen days commencing ten days after the 8 notice of liability for the sixth violation has been mailed. 9 (b) The registration of a vehicle which has been documented nine times 10 within a twenty-four month period by a photo violation monitoring device 11 for failure of an operator thereof to comply with traffic-control indi- 12 cations shall be suspended for a period of thirty days commencing ten 13 days after the notice of liability for the ninth violation has been 14 mailed. 15 (c) The registration of a vehicle which has been documented twelve 16 times within a thirty-six month period by a photo violation monitoring 17 device for failure of an operator thereof to comply with traffic-control 18 indications shall be suspended for a period of ninety days commencing 19 ten days after the notice of liability for the twelfth violation has 20 been mailed. 21 (d) This section shall not apply to a rental vehicle, as defined in 22 section one hundred thirty-seven-a of this chapter. This act shall take effect immediately.
