CUNNINGHAM, RAGA, BURDICK, SIMONE, DE LOS SANTOS, LUNSFORD, SIMON -- read once and referred to the Committee on Trans- portation AN ACT to amend the vehicle and traffic law, in relation to mandating the use of advanced safety technology in vehicles in the state and requiring the commissioner of motor vehicles to promulgate certain rules and regulations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 375 of the vehicle and traffic law is amended by 2 adding two new subdivisions 58 and 59 to read as follows: 3 58. (a) Every motor vehicle registered in this state and manufactured 4 or assembled on or after January first, two thousand twenty-seven shall 5 be equipped with advanced safety technology. 6 (b) As used in this subdivision, "advanced safety technology" includes 7 active Intelligent Speed Assistance (ISA), Advanced Emergency Braking 8 (AEB), Emergency Lane Keeping Systems (ELKS), Blind Spot Information 9 Systems (BSIS), drowsiness and distraction recognition technology, rear- 10 view camera sensor systems, and Event Data Recorders (EDR). BSIS shall 11 include cyclist and pedestrian detection technology. EDR devices shall 12 provide standardized and easily accessible data. The commissioner, after 13 a public hearing, shall promulgate regulations providing specifications 14 for each type of technology required by this subdivision. 15 59. The commissioner, after a public hearing, shall promulgate rules 16 and regulations for vehicles registered in this state and manufactured 17 or assembled on or after January first, two thousand twenty-seven, with 18 a weight of three thousand pounds or more, establishing standards of 19 direct visibility of pedestrians, cyclists and other vulnerable road 20 users from the driver's position, by reducing to the greatest possible 21 extent the blind spots in front and to the side of the driver. 22 § 2.
