  STATE OF NEW YORK ________________________________________________________________________ 2696 2025-2026 Regular Sessions  IN ASSEMBLY January 22, 2025 ___________ Introduced by M. of A. RAJKUMAR -- read once and referred to the Commit- tee on Labor AN ACT to amend the labor law, in relation to requiring minimum wage for public employees The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (h), (i) and (m) of the opening paragraph of 2 subdivision 5 of section 651 of the labor law, as amended by chapter 391 3 of the laws of 2024, are amended to read as follows: 4 (h) in or for such a religious, educational or charitable institution 5 if such individual is a student, provided that this exception shall not 6 apply to a public educational institution; (i) in or for such a reli- 7 gious, educational or charitable institution if the earning capacity of 8 such individual is impaired by age or by physical or mental deficiency 9 or injury, provided that this exception shall not apply to a public 10 educational institution; 11 (m) by [a] the federal[, state or municipal] government [or political 12 subdivision thereof]; 13 § 2. Subdivision 6 of section 651 of the labor law, as amended by 14 chapter 281 of the laws of 2002, is amended to read as follows: 15 6. "Employer" includes any individual, partnership, association, 16 corporation, limited liability company, business trust, legal represen- 17 tative, state or local government, or any organized group of persons 18 acting as employer. 19 § 3.
