  STATE OF NEW YORK ________________________________________________________________________ 2742 2025-2026 Regular Sessions  IN ASSEMBLY January 22, 2025 ___________ Introduced by M. of A. JACOBSON -- read once and referred to the Commit- tee on Election Law AN ACT to amend the election law, in relation to the deadline for filing a certification required to be eligible for voluntary public financing or withdraw from the program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (d) of subdivision 1 of section 14-203 of the 2 election law, as added by section 4 of part ZZZ of chapter 58 of the 3 laws of 2020, is amended and a new subdivision 3 is added to read as 4 follows: 5 (d) submit a certification in the form of an affidavit, in such form 6 as may be prescribed by the PCFB, that sets forth [his or her] the 7 candidate's acceptance of and agreement to comply with the terms and 8 conditions for the provision of such funds in each covered election and 9 such certification shall be submitted [at least four months before a 10 primary election] no later than thirty days after the last day to file 11 designating petitions, if another candidate for the same position files 12 a designating petition, or no later than thirty days after the last day 13 to file independent nominating petitions, if a candidate files an inde- 14 pendent nominating petition for the same position, and on the last day 15 in which a certification of nomination is filed in a special election 16 pursuant to a schedule promulgated by the PCFB; 17 3. Withdrawal. A candidate may withdraw from the public campaign 18 financing program at any time provided that prior to the withdrawal, all 19 money received from the program shall be returned to the public financ- 20 ing board by either certified check or wire transfer. 21 § 2.
