What A 279 does, verified January 30, 2026

The proposed constitutional amendment aims to protect and promote the mental health of New Yorkers. The amendment would require the state to provide for the protection and promotion of the physical and mental health of its inhabitants, and would give the legislature the authority to determine how this provision should be implemented. Additionally, the amendment would ensure that state and local authorities provide care and treatment for individuals suffering from mental disorders or defects, and would allow the head of the department of mental hygiene to inspect and visit institutions used for care and treatment. The amendment would be referred to the first regular legislative session after the next general election and would be published for three months prior to that election.
