A 3028: Allows domestic insurers to make certain records available by electronic means if they are easily accessible from the insurer's principal office in this state and the insurer complies with all applicable state and federal laws and regulations.
The bill aims to amend the insurance law to allow domestic insurers to make certain records available by electronic means. Domestic insurers and licensed United States branches of alien insurers must keep and maintain records at their principal office in the state, including charter and by-laws, books of account, shareholder records, and meeting minutes. These records can be stored on servers accessible through the internet, an internal server, or a third-party service provider, as long as they are easily accessible from the insurer's principal office and comply with state and federal laws and regulations. The records must be available in English, with accurate translations provided if they are kept in a different language. The amendments take effect immediately.
