A 3102: Conforms the definition of an incarcerated individual with a serious mental illness to the definition of "person with a serious mental illness" in the mental hygiene law.
The bill aims to improve the treatment of incarcerated individuals with serious mental illnesses. A serious mental illness is defined as a condition that requires treatment and can significantly impact an individual's life. The bill expands the list of mental health conditions that qualify as serious mental illnesses, including schizophrenia, delusional disorder, and bipolar disorder. The bill requires that an incarcerated individual be diagnosed with one of these conditions to be considered a person with a serious mental illness. This diagnosis must be made based on all relevant clinical factors, including symptoms related to the condition. The bill also establishes a specific timeline for when the law will take effect, after the bill has become a law for at least 90 days.
