A 330: Relates to the postmark date for change of enrollment.
The bill proposes to amend the election law to change the date for when enrollment changes take effect. Currently, changes received after February 14th and before the June primary take effect on the seventh day after the June primary. However, the bill would allow changes received after February 14th to take effect immediately, unless they are contained in an envelope with a dated cancellation mark of the United States post office, in which case they would take effect on the seventh day after the June primary. The bill would also take effect immediately.

PAULIN, SEAWRIGHT, SIMON, MAGNARELLI, COLTON -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to the date for change of enrollment The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 5-304 of the election law, as 2 amended by chapter 316 of the laws of 2019, is amended to read as 3 follows: 4 3. A change of enrollment received by the board of elections will take 5 effect immediately, provided however, any change of enrollment received 6 by the board of elections after February fourteenth and before or on 7 seven days after the June primary either showing a dated cancellation 8 mark of the United States Post Office or contained in an envelope show- 9 ing such a dated cancellation mark which is later than February four- 10 teenth or not showing a dated cancellation mark of the United States 11 Post Office and if contained in an envelope not showing such a dated 12 cancellation mark on such envelope shall take effect on the seventh day 13 after the June primary. 14 § 2.
