A 3334: Includes injury to an on-duty auxiliary police officer within the elements of assault in the second degree.
The proposed law aims to enhance protections for members of auxiliary police programs. It amends the Penal Law to make it a crime to intentionally cause physical harm to a peace officer, police officer, or auxiliary police officer while they are performing their duties. This includes individuals such as firefighters, emergency medical technicians, and city marshals. The law also expands the definition of "school grounds" to include areas where students are present for educational purposes. Additionally, it clarifies that the law applies to individuals who cause physical harm to a school employee or student, and to individuals who intentionally cause physical harm to a student while the student is present for educational purposes. The law takes effect sixty days after it becomes law.
