A 352: Authorizes the commissioner of health to withhold reimbursements from medical assistance programs to retail entities who decline to make available, dispense, distribute, or sell a product approved by the federal government which would block, prevent, or otherwise negate a pregnancy in any jurisdiction within and subject to such federal government.
The proposed legislation aims to withhold funding from certain retail entities that refuse to provide or sell a pregnancy-preventing product approved by the federal government. The state's commissioner is authorized to take such action, which may include withholding funds from entities doing business in other states or jurisdictions with a common ownership or brand. This measure is intended to incentivize retail entities to make available, dispense, distribute, or sell products that block, prevent, or negate pregnancy. The changes will take effect immediately.
