A 363: Relates to the eligibility for awards for victims of a crime; includes the commission of suicide within two years after being a victim of a crime as a death that is the direct result of a crime.
The bill aims to amend the Executive Law to provide awards for victims of a crime. A surviving spouse of a crime victim who died from causes not directly related to the crime can receive an award for out-of-pocket losses incurred as a direct result of the crime. A spouse, child, or stepchild of a victim who sustained personal physical injury as a direct result of the crime can also receive an award. The bill also establishes that a victim who commits suicide within two years after the crime shall be deemed to have died as a direct result of the crime, unless the office determines otherwise. This provision disregards the victim's responsibility for their own injury if they committed suicide within two years after the crime. The changes take effect immediately.
