A 4016: Imposes fines for failure to exercise due care and move over when approaching parked, stopped or standing motor vehicles on the shoulder of a highway.
The proposed law aims to increase penalties for drivers who fail to exercise due care when approaching parked, stopped, or standing vehicles on the shoulder of a highway. It introduces a new system of fines and imprisonment for drivers convicted of such violations. The penalties increase with the number of previous convictions within an 18-month period, with the maximum fine and imprisonment amounting to $750 or 90 days, respectively, for a third or subsequent violation. The law will take effect on January 1, 2026, and will apply to all violations committed after this date.
