A 4162: Relates to Medicaid reimbursement rates for private duty nursing; requires DOH to publish a private duty rate schedule.
The bill aims to increase reimbursement rates for private duty nursing services. It requires Medicaid enrollees to receive private duty nursing services at a benchmark rate, which is the fee-for-service rate calculated by the state, starting from October 26, 2026. The rates will be at least 80% of the applicable maximum allowable charge based on the New York locality, with the maximum allowable charge adjusted annually. The Department of Health will publish a private duty rate schedule at least 30 days prior to the effective date of the increase and annually thereafter. The amendments will take effect immediately, but the repeal of section 364-j of the social services law will occur at the same time.
