Assembly BillIntroduced
A 5105: Relates to the criminal possession of a ghost gun; makes such possession a class C felony unless you are a licensed gunsmith or dealer in firearms with intent to manufacture and/or distribute such firearms; requires educational materials shall be provided for no less than 2 years after the effective date of such provisions.
What A 5105 does, verified May 22, 2026
The proposed law aims to amend the penal law to address the issue of ghost guns. A ghost gun is a firearm that is not detectable by metal detectors or other security screening devices. The law would make it a crime to possess a ghost gun, with the exception of individuals who surrender the gun to law enforcement. The law would also not apply to individuals who are licensed gunsmiths or dealers. Additionally, the law would provide educational materials to the public about the dangers of ghost guns. The penalties for possessing a ghost gun would be the same as those for possessing other firearms, with possession of a ghost gun being a class C felony.
