The bill aims to amend the Correction Law and the Civil Practice Law and Rules to establish a new evidentiary standard for evidentiary and disciplinary hearings. The new standard will require a preponderance of the evidence for all such hearings, meaning that the evidence presented must be more likely to be true than not true. This change will apply to hearings held pursuant to the law, and it will supersede the existing substantial evidence standard. The bill will take effect 90 days after it becomes a law.
