A 71: Permits a liability policy to provide coverage for punitive damages, civil penalties and other non-compensatory damages.
The proposed law allows insurance companies to provide coverage for punitive damages, civil penalties, and other non-compensatory damages in liability insurance policies. This coverage is not available in personal lines insurance for non-business purposes or commercial automobile liability insurance policies. The coverage can also provide protection for vicarious liability resulting from the conduct of another, but it does not apply to actions intended to cause harm. The coverage is only available when expressly provided for by the insurance policy. The law takes effect immediately, and it applies to insurance policies with effective dates on or after the effective date of the law.
