What A 721 does, verified January 11, 2026

The bill aims to amend the Public Health Law and the Penal Law to provide clarity and protection for health care proxies. A health care proxy can now be signed in the presence of one adult witness, instead of two, for individuals living in facilities operated by the Office of Mental Health or the Office for People with Developmental Disabilities. The bill also clarifies the process for signing a health care proxy for individuals who are unable to do so themselves, allowing a non-witness to sign the document at the individual's direction. Additionally, the bill modifies the Penal Law to clarify the definition of forgery in the second degree and to provide further protection for individuals signing certain documents, such as deeds, wills, and contracts. The amendments to the laws will take effect on the ninetieth day after the bill becomes a law.
