CARROLL -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to reducing tuition rates for certain Olympic athletes The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph h of subdivision 2 of section 355 of the educa- 2 tion law is amended by adding a new subparagraph 11 to read as follows: 3 (11) Such regulations shall further provide that the payment of 4 tuition and fees by any Team USA athlete training in the state shall be 5 paid at a rate or charge no greater than that imposed for students who 6 are residents of this state for as long as they remain members of Team 7 USA, or for the first four years of their education, whichever is short- 8 er. For purposes of this section, "Team USA student athlete" means any 9 student athlete who meets the eligibility standards defined and approved 10 by the United States Olympic and Paralympic Committee and by the 11 national governing body for the sport in which the athlete competes. 12 § 2. Subdivision 5 of section 5711 of the education law, as amended by 13 chapter 270 of the laws of 1975, is amended to read as follows: 14 5. The tuition fees charged to students shall be regulated by Cornell 15 university after consultation with the state university trustees [and16all]. Such regulations shall provide that the payment of tuition and 17 fees by any Team USA student athlete, as defined in subparagraph eleven 18 of paragraph (h) of subdivision two of section three hundred fifty-five 19 of this chapter, training in the state shall be paid at a rate or charge 20 no greater than that imposed for students who are residents of this 21 state for as long as they remain members of Team USA, or for the first 22 four years of their education, whichever is shorter. Subdivision 5 of section 5712 of the education law, as amended by 4 chapter 833 of the laws of 1971, is amended to read as follows: 5 5. The tuition fees charged to students shall be regulated by Cornell 6 university after prior consultation with the state university trustees 7 [and all]. Such regulations shall provide that the payment of tuition 8 and fees by any Team USA student, as defined in subparagraph eleven of 9 paragraph (h) of subdivision two of section three hundred fifty-five of 10 this chapter, training in the state shall be paid at a rate or charge no 11 greater than that imposed for students who are residents of this state 12 for as long as they remain members of Team USA, or for the first four 13 years of their education, whichever is shorter. All other fees and 14 charges in said college of agriculture and life sciences shall be fixed 15 by Cornell university, and the moneys received from these sources and 16 from the sales of products shall be credited to a separate fund and 17 shall be used for the current expenses of the said college of agricul- 18 ture and life sciences. 19 § 4. Subdivision 6 of section 5714 of the education law, as amended by 20 chapter 265 of the laws of 1969, is amended to read as follows: 21 6. The tuition fees charged to students shall be regulated by Cornell 22 university after prior consultation with the state university trustees 23 [and all]. Such regulations shall provide that the payment of tuition 24 and fees by any Team USA student athlete, as defined in subparagraph 25 eleven of paragraph (h) of subdivision two of section three hundred 26 fifty-five of this chapter, training in the state shall be paid at a 27 rate or charge no greater than that imposed for students who are resi- 28 dents of this state for as long as they remain members of Team USA, or 29 for the first four years of their education, whichever is shorter. All 30 other fees and charges in said college of human ecology shall be fixed 31 by Cornell university, and the moneys received from these sources and 32 from the sales of products shall be credited to a separate fund and 33 shall be used for the expenses of said college of human ecology in such 34 ways as the trustees of said university may determine. 35 § 5. Paragraph b of subdivision 6 of section 5715 of the education 36 law, as amended by chapter 389 of the laws of 1961, is amended to read 37 as follows: 38 b. The tuition fees charged to students shall be regulated by Cornell 39 university after prior consultation with the state university trustees 40 [and all]. Such regulations shall provide that the payment of tuition 41 and fees by any Team USA student athlete, as defined in subparagraph 42 eleven of paragraph (h) of subdivision two of section three hundred 43 fifty-five of this chapter, training in the state shall be paid at a 44 rate or charge no greater than that imposed for students who are resi- 45 dents of this state for as long as they remain members of Team USA, or 46 for the first four years of their education, whichever is shorter. All 47 other fees and charges in such school shall be fixed by Cornell univer- 48 sity. 49 § 6. Section 6007 of the education law, as amended by chapter 389 of 50 the laws of 1961, is amended to read as follows: 51 § 6007. Tuition; disposition of fees and income. The state university 52 trustees shall regulate tuition fees and other fees and charges to be 53 paid by students after prior consultation with the board of trustees of 54 the college. Such regulations shall provide that the payment of tuition 55 and fees by any Team USA student athlete, as defined in subparagraph 56 eleven of paragraph (h) of subdivision two of section three hundredA. 761 3 1 fifty-five of this chapter, training in the state shall be paid at a 2 rate or charge no greater than that imposed for students who are resi- 3 dents of this state for as long as they remain members of Team USA, or 4 for the first four years of their education, whichever is shorter. All 5 moneys received for tuition from students, those derived from the sale 6 of the products of property belonging to the state administered by the 7 college, and from fees and charges or any other sources in the course of 8 the administration of the college, notwithstanding the provisions of 9 section one hundred twenty-one of the state finance law, shall be cred- 10 ited to a separate fund and shall be expended as provided by subdivision 11 four of section three hundred fifty-five of this chapter. 12 § 7. Section 6102 of the education law, as amended by chapter 389 of 13 the laws of 1961, is amended to read as follows: 14 § 6102. Administration. Such college shall continue to be adminis- 15 tered, as to the establishment of courses of study, the creation of 16 departments and positions, the determination of the number and salaries 17 of members of the faculty and other employees, the apportionment and 18 employment thereof, the maintenance of discipline and as to all matters 19 pertaining to its educational policies, activities and operations, 20 including research work, by Alfred university, as the representative of 21 the state university trustees. All property and equipment acquired for 22 the use of such college shall be the property of the state. Alfred 23 university shall regulate tuition fees at such college after prior 24 consultation with the state university trustees. Such regulations shall 25 provide that the payment of tuition and fees by any Team USA student 26 athlete, as defined in subparagraph eleven of paragraph (h) of subdivi- 27 sion two of section three hundred fifty-five of this chapter, training 28 in the state shall be paid at a rate or charge no greater than that 29 imposed for students who are residents of this state for as long as they 30 remain members of Team USA, or for the first four years of their educa- 31 tion, whichever is shorter. As the representative of the state univer- 32 sity trustees, Alfred university shall also fix the other fees and 33 charges to be paid by the students of the college. 34 All moneys received for tuition from students, those derived from the 35 sale of products of property belonging to the state administered by the 36 college, and from fees and charges, or any other sources in the course 37 of the administration of the college, notwithstanding the provisions of 38 section one hundred twenty-one of the state finance law, shall be cred- 39 ited to a separate fund and shall be expended for the current expenses 40 of such college and for its benefits in such way as Alfred university, 41 as the representative of the state university trustees, may determine. 42 The amounts so received and expended shall be reported annually to the 43 state comptroller. 44 § 8. Subdivision 7 of section 6206 of the education law is amended by 45 adding a new paragraph (g) to read as follows: 46 (g) The trustees shall further provide that the payment of tuition and 47 fees by any Team USA student athlete, as defined in subparagraph eleven 48 of paragraph (h) of subdivision two of section three hundred fifty-five 49 of this chapter, training in the state shall be paid at a rate or charge 50 no greater than that imposed for students who are residents of this 51 state for as long as they remain members of Team USA, or for the first 52 four years of their education, whichever is shorter. 53 § 9. Paragraph (iii) of subdivision 5 of section 6301 of the education 54 law, as amended by chapter 327 of the laws of 2002, is amended and a new 55 paragraph (iv) is added to read as follows:A. 761 4 1 (iii) was enrolled in an institution or educational unit of the state 2 university in the fall semester or quarter of the two thousand one--two 3 thousand two academic year and was authorized by such institution or 4 educational unit to pay tuition at the rate or charge imposed for 5 students who are residents of the state[.]; or 6 (iv) is a Team USA student athlete, as defined in subparagraph eleven 7 of paragraph (h) of subdivision two of section three hundred fifty-five 8 of this chapter, in the first four years of their education. 9 § 10. This act shall take effect on the first of July next succeeding 10 the date on which it shall have become a law.
