Additionally, the bill requires stores to maintain records of plastic bag and film plastic collection and recycling for at least three years. Retail dry cleaning establishments are also allowed to return clothing to customers in reusable bags or for sale. The bill takes effect 180 days after it becomes a law.

  STATE OF NEW YORK ________________________________________________________________________ 776 2025-2026 Regular Sessions  IN ASSEMBLY (Prefiled) January 8, 2025 ___________ Introduced by M. of A. EPSTEIN -- read once and referred to the Commit- tee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to the use of single use plastic garment bags by dry cleaning establishments The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new section 2 391-w to read as follows: 3 § 391-w. Single use plastic garment bags. 1. For the purposes of this 4 section, the term "reusable bag" shall mean a bag: (a) made of cloth or 5 other machine washable fabric with or without handles; or (b) a durable 6 bag with or without handles that is specifically designed and manufac- 7 tured for multiple reuses. 8 2. A retail dry cleaning establishment shall not return clothing to 9 customers in single use plastic garment bags, except upon request by a 10 customer. 11 3. A retail dry cleaning establishment may return clothing to a 12 customer in a reusable bag provided by such customer. 13 § 2. This act shall take effect immediately.
