A 8233: Establishes a cannabis processor tax credit; authorizes a tax credit that is the equivalent to the licensed processor's cannabis potency tax liability for the year two thousand twenty-three, multiplied by three, but shall not exceed four hundred thousand dollars.
The bill aims to establish a tax credit for cannabis processors in New York. A licensed processor is eligible for a refundable credit against the cannabis potency tax if they meet certain requirements. The credit is calculated by multiplying the processor's cannabis potency tax liability for 2023 by three, but capped at $400,000. The credit is limited to $400,000 for partnerships and corporations. The processor must file returns showing the amount of cannabis potency tax due in 2023 to be eligible for the credit. Any outstanding tax owed by the processor can be deducted from the credit before application or disbursement. The bill takes effect immediately and applies to taxable years beginning on or after January 1, 2025.
