A 8745: Provides for an adverse inference against the testimony of an officer or other employee of the department of corrections and community supervision, where such officer or other employee violated department rules or regulations by turning off a facility camera or body-worn camera or otherwise prevented such camera or cameras from recording the incident which is the subject of such disciplinary proceeding.
What A 8745 does, verified May 1, 2026
The bill aims to provide an adverse inference in disciplinary proceedings against correction officers who disable facility cameras or body-worn cameras. This means that if a correction officer is found to have turned off a camera or prevented it from recording an incident, the court will infer that the officer is guilty of misconduct. The bill applies this rule to disciplinary proceedings of incarcerated individuals in correctional facilities. The adverse inference is intended to hold correction officers accountable for their actions and ensure that the public and the individuals being disciplined have a clear understanding of what occurred.
