A 8770: Requires sellers of new residential construction to inform buyers of any price increase caused by tariffs on building materials.
The proposed law aims to increase transparency in the new residential construction market by requiring sellers to inform buyers about price increases caused by tariffs on building materials. The law defines "new residential construction" as recently built homes and units, excluding those constructed for lease, mobile homes, and homes where the builder has resided or leased continuously for three years or more. Sellers must provide a tariff cost estimate, which includes all increases in price attributable to tariffs, to buyers or potential buyers. This information must be clearly indicated in all listings, including online listings, advertising materials, purchase agreements, and contracts. The law takes effect immediately, requiring sellers to disclose tariff-related price increases to buyers.
