What A 9045 does, verified January 8, 2026

The bill aims to regulate reimbursement rates of pharmacy benefit managers in New York. It requires pharmacy benefit managers to reimburse pharmacies for therapeutically equivalent drugs at the pharmacy's acquisition cost, rather than the previously used maximum allowable cost. If a pharmacy is unable to purchase a therapeutically equivalent drug at a cost equal to or less than the previously challenged maximum allowable cost, the pharmacy benefit manager must adjust their pricing methodology to reflect the pharmacy's actual acquisition cost. The bill also prohibits pharmacy benefit managers from reimbursing pharmacies less than the amount they pay to their affiliates for providing the same services. The bill takes effect on the 90th day after it becomes a law.
