Assembly BillIntroduced
A 9341: Provides that the failure of a party challenging a building permit, variance, subdivision or other land use approval to seek a preliminary injunction to prevent construction shall not give rise to the opposing party raising the defense of mootness if such party continues and/or completes construction with knowledge that an action challenging its land use approval has been timely commenced.
What A 9341 does, verified January 8, 2026
The bill aims to modify the New York state law regarding preliminary injunctions. It prohibits a party that challenges a building permit or land use approval from raising the defense of mootness if they continue or complete construction despite knowing that an action challenging the land use approval has been timely commenced. This means that even if the challenge is filed after construction has begun, the party opposing the challenge cannot claim that the issue is moot. The proposed change takes effect immediately.
